2. Past lost wages
Past wage loss provides compensation for the income you were unable to earn while you were unable to work due to your injury.
In Missouri, past wage loss refers to the income you were unable to earn while you were off work because of your injury. Even if you used sick leave, vacation days, or PTO, it still counts as a loss, since those days can no longer be used in the future. Courts calculate past wage loss by reviewing your pay stubs, W-2 forms, tax returns, employer statements, and medical documentation confirming you could not work. Missouri does not offer automatic weekly income replacement through auto insurance, so there is no set benefit like $250 per week. Instead, some employees may receive partial income through employer provided short term or long term disability insurance, usually replacing about 40 percent to 70 percent of wages. Any remaining loss that is not covered must be recovered from the at fault party and their insurance company through a personal injury claim.
3. Loss of future lost wages
Loss of future wages is awarded when you can demonstrate that your injuries from the accident will likely cause you to miss out on income in the future.
4. Loss of earning capacity
Lost earning capacity compensates you if there is a real risk that your capacity to earn income in the future has been reduced.
Lost earning capacity compensates you for the income you are likely to lose in the future because your injury reduces your ability to work at the same level. For example, if a construction worker or carpenter loses an arm, they will have a reduced earning potential because they cannot perform their job with the same speed, strength, or efficiency. In Missouri, calculating future earning capacity includes considering expected promotions, annual wage increases, overtime potential, career advancement, and the value of skills or experience that would have led to higher future income. Courts also evaluate your remaining working years based on your age and career path. Medical evidence is reviewed to determine whether your condition is permanent or likely to improve, and if the symptoms may lessen over time, the court may apply a reduction to reflect that improvement.
5. Loss of valuable services
Loss of valuable services compensates you for your reduced capacity to perform any valuable service for which you are not paid.
In Missouri, not all work we perform is paid, but it still has real value. Compensation for housekeeping loss was once treated as part of general damages, but modern courts recognize the economic value of unpaid household labor. Housekeeping and home maintenance are services most people perform for themselves without pay, yet these tasks carry a measurable cost when an injury limits your ability to do them. Missouri courts assess this loss by comparing the household chores you were able to perform before the accident with what you can reasonably do afterward. You may receive compensation for this loss even if you did not hire someone to help you, because the law recognizes the value of the services you can no longer perform.
6. Cost of future care
Cost of future care compensates you for the future medical care you will require due to your injury.
Missouri law recognizes that an injured person should not have to pay out of pocket for adaptations, treatments, medical equipment, assistive devices, or medications that become necessary because of someone else’s negligence. When evidence shows that ongoing or future care will be required, courts can award damages for these expenses under the category known as the cost of future care.
7. Out of pocket expenses
You can seek compensation for any expenses you've paid out of pocket as a result of your injury.
